These Terms of Service ("Terms") govern your use of the Mountain West Hydro Jetting & Sewer Maintenance LLC ("Mountain West," "we," "us," or "our") website at mountainwesthydrojetting.com, including free quote requests, appointment scheduling, marketing communications sign-up, and all communications submitted through this website.

By using this website, you agree to these Terms. If you do not agree, do not use the website.

1. Use of This Website

1.1 Permitted Use. You may use this website to learn about Mountain West's services, request quotes, book service appointments, sign up for marketing communications, and communicate with Mountain West.

1.2 Prohibited Use. You agree not to:

  1. Use the website for any unlawful purpose
  2. Submit false, misleading, or inaccurate information
  3. Interfere with the website's operation, security, or performance
  4. Attempt to gain unauthorized access to any part of the website or its systems
  5. Use automated tools (bots, scrapers, crawlers) to access or extract data from the website without written permission
  6. Submit spam, fraudulent requests, or multiple duplicate bookings
  7. Impersonate another person or misrepresent your authority to request services at a property

2. Quotes and Bookings

2.1 Quotes. Information submitted through this website may be used to provide estimates, respond to questions, and schedule service appointments. Quote requests are not binding offers. Estimates provided through the website or by phone are preliminary and based on the information you provide. Final scope, recommended service, timing, and price depend on technician review, site conditions, access conditions, safety considerations, and the actual issue found at the property.

2.2 Bookings. A service booking made through this website reserves an appointment slot, but does not guarantee that the job will be completed within the exact window shown. Appointment availability and scheduling remain subject to technician availability, travel conditions, prior jobs, weather, property-access details, emergency calls, and other operational factors.

2.3 Service Agreement Required. All service work is governed by Mountain West's Residential or Commercial Master Service Agreement and the applicable Service Exhibit(s), which will be provided for signature before work begins. The service agreement — not these Terms of Service — governs the scope, price, warranty, payment terms, liability, and dispute resolution for the work performed. These Terms govern only your use of the website.

3. Customer Responsibilities

By submitting a request through this website, you agree to provide:

  1. Correct contact details (name, phone, email)
  2. Accurate property address information
  3. Relevant service notes, access instructions, and scheduling details
  4. Prompt notice if an appointment needs to be changed or canceled
  5. Safe and reasonable access to the service location when our team arrives

You represent that you are the owner of the property at the service address or have lawful authority to request services at that property.

4. Rescheduling and Cancellation

If you need to change or cancel an appointment, contact Mountain West as soon as possible at (801) 317-8104 or info@mountainwesthydrojetting.com. We may also need to reschedule appointments because of emergency calls, technician availability, safety concerns, access issues, weather, or other operational reasons. We will notify you as soon as practicable if we need to reschedule.

5. Marketing Communications

5.1 Opt-In. When submitting a quote or booking request, or at any other time, you may choose to opt in to receive marketing communications from Mountain West, including promotional emails and/or SMS text messages. Marketing communications are entirely optional and are not required to receive service.

5.2 Consent. By opting in to marketing communications, you consent to receive the types of communications you selected (email, SMS, or both) at the contact information you provide. For SMS marketing, your opt-in constitutes express written consent under the Telephone Consumer Protection Act (TCPA) to receive recurring promotional text messages from Mountain West. Message frequency varies. Message and data rates may apply.

5.3 Opt-Out. You may opt out of marketing communications at any time. For email, click "Unsubscribe" in any marketing email. For SMS, reply STOP to any marketing text message. You may also contact us at info@mountainwesthydrojetting.com or (801) 317-8104 to update your preferences. See our Privacy Policy for full details.

5.4 Service Communications. Opting out of marketing does not affect service-related transactional messages (appointment confirmations, arrival updates, invoice notices) related to services you have requested or received.

6. Advertising Technologies

6.1 Tracking and Retargeting. This website uses tracking pixels and cookies from third-party advertising platforms to deliver and measure the effectiveness of our online advertising campaigns. Platforms we currently use or may use include Meta (Facebook/Instagram), Google Ads (including YouTube), TikTok, Snapchat, LinkedIn, X (formerly Twitter), Pinterest, and other advertising networks. If you visit this website with marketing cookies enabled, you may later see Mountain West ads on these platforms. This is called retargeting.

6.2 Your Choices. You can manage your advertising and cookie preferences through the "Cookie Settings" link in the website footer, through each platform's ad preference settings, or through industry opt-out tools. See our Privacy Policy (Section 6) and Cookie Policy for full details, platform-specific opt-out links, and industry opt-out tools.

6.3 No Sale of Personal Data. Mountain West does not sell your personal information to advertising platforms. Tracking pixels collect website visit data (pages viewed, actions taken) to deliver and measure ads, but we do not upload your name, email, phone number, or service address to advertising platforms for their independent use.

7. No Guarantee of Outcomes

Website content is provided for general informational purposes. Service recommendations, timelines, availability, and estimated booking windows shown on the website do not guarantee a particular result, price, diagnosis, repair method, or project scope until the service request is reviewed and confirmed by our team on the facts of the actual job. Photographs, descriptions, and examples on the website are for illustrative purposes and do not guarantee identical results.

8. Communications

By submitting a quote or booking request, you authorize Mountain West to contact you about that request by phone, text message, or email using the contact information you provide. These service-related communications may include scheduling details, arrival updates, quote follow-up, invoice notices, and service-related notices. This authorization applies to the specific service request you submitted and does not constitute consent to marketing communications (which requires separate opt-in as described in Section 5).

9. User-Submitted Content

9.1 Reviews and Testimonials. If you submit a review, testimonial, or feedback through the website or through a third-party platform (Google, Facebook, etc.), you grant Mountain West a non-exclusive, royalty-free, perpetual license to use, display, and reproduce your review for business purposes, including on our website and marketing materials. Mountain West will not alter the substance of your review.

9.2 Accuracy. You represent that any content you submit through the website is accurate, not misleading, and does not violate the rights of any third party.

10. Third-Party Services

This website relies on third-party tools and providers, including:

  5. Website hosting and infrastructure providers
  6. Email, phone, and messaging tools

Use of those tools may be subject to the terms or policies of those third parties. Mountain West is not responsible for the availability, accuracy, or practices of third-party services.

11. Intellectual Property

11.1 Mountain West Content. The website design, text, branding, logos, graphics, photographs, videos, and other site content are owned by or used with permission by Mountain West and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any Mountain West content without prior written permission.

11.2 Trademarks. "Mountain West Hydro Jetting & Sewer Maintenance" and associated logos and brand elements are trademarks of Mountain West. Use of Mountain West's trademarks without written permission is prohibited.

12. Disclaimer of Warranties

THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOUNTAIN WEST DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOUNTAIN WEST IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS WEBSITE OR RELIANCE ON ITS CONTENT, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY. MOUNTAIN WEST'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THIS WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR WILLFUL MISCONDUCT.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mountain West, its owners, members, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from: (i) your use of the website; (ii) your violation of these Terms; (iii) your submission of inaccurate or misleading information; or (iv) your infringement of any third party's rights.

15. Governing Law and Disputes

15.1 Governing Law. These Terms are governed by the laws of the State of Utah.

15.2 Venue. Any dispute arising from these Terms or your use of this website will be resolved in the state courts of Davis County, Utah, or the applicable federal court serving that county. You consent to personal jurisdiction in those courts.

15.3 Limitation on Claims. Any claim arising from use of this website must be brought within one (1) year after the claim arose, or the claim is permanently barred.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Continued use of the website after updates are posted means you accept the revised Terms.
